This is the legal agreement between you and TheraJoy Studio Inc. We've tried to keep it plain. The italicized notes next to each section are not part of the contract — they're our translation of what the clause means.
By creating an account or using TheraJoy (the "Service"), you agree to these Terms. If you don't agree, don't use the Service. These Terms are between you and TheraJoy Studio Inc. ("TheraJoy," "we"), a Delaware corporation headquartered in Oakland, California.
TheraJoy is a consumer wellness application that generates rhythmic bilateral stimulation. It is not a medical device, is not intended to diagnose, treat, cure, or prevent any condition, and is not a substitute for licensed medical or mental-health care. Please also read our safety and disclaimer page.
You must be at least 13 years old. If you are under 18, you must have a parent or legal guardian's permission and supervision. You must provide accurate registration information and keep your login credentials secure.
We grant you a personal, non-exclusive, non-transferable, revocable license to use TheraJoy for your own use, or — for Practice accounts — the use of your practice and its clients, in accordance with these Terms.
Anything you create inside TheraJoy — presets, reflections, notes — is yours. You grant us a narrow license to store and process it for the purpose of running the Service for you, and nothing else. We do not use your content to train machine-learning models or for any other purpose.
Our handling of your personal information is described in our privacy notice, which is part of these Terms by reference.
If you're on the Practice plan, the Business Associate Agreement you sign during onboarding governs our handling of any Protected Health Information (PHI) covered by HIPAA. That BAA supplements these Terms; where it conflicts, the BAA controls for PHI.
We'll try very hard to keep the Service up, but we don't promise zero downtime. We occasionally push updates that add, change, or remove features. Material removals are announced in the changelog, and we try to tell you by email when a feature you use is going away.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TheraJoy'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts of Alameda County, California, unless you have a non-waivable consumer right to arbitrate or sue elsewhere.
If we update the Terms materially, we'll email you at least 14 days ahead. Continued use after the effective date counts as acceptance. If you don't agree to a change, cancel before it takes effect.
