The short terms.

This is the legal agreement between you and TheraJoy Studio Inc. We've tried to keep it plain. The italicized notes next to each section are not part of the contract — they're our translation of what the clause means.

1. The basics.

By creating an account or using TheraJoy (the "Service"), you agree to these Terms. If you don't agree, don't use the Service. These Terms are between you and TheraJoy Studio Inc. ("TheraJoy," "we"), a Delaware corporation headquartered in Oakland, California.

Use the app; follow the rules; that is the deal.

2. What the Service is.

TheraJoy is a consumer wellness application that generates rhythmic bilateral stimulation. It is not a medical device, is not intended to diagnose, treat, cure, or prevent any condition, and is not a substitute for licensed medical or mental-health care. Please also read our safety and disclaimer page.

It is a quiet tool; it is not a treatment.

3. Who can use it.

You must be at least 13 years old. If you are under 18, you must have a parent or legal guardian's permission and supervision. You must provide accurate registration information and keep your login credentials secure.

4. Your subscription.

  1. Free tier. You may use TheraJoy Lite at no cost. It has limited features and no expiration.
  2. Paid plans. Quiet ($9/mo) and Practice ($49/mo per clinician) are billed in advance, monthly or annually, via your App Store account or Stripe.
  3. Free trial. Quiet includes a 14-day trial. Cancel any time before day 14 and you will not be charged.
  4. Refunds. We offer a full refund within 30 days of the first charge, no questions asked. Write to help@therajoy.co.
  5. Cancellation. Cancel in Settings → Subscription, or via the App Store. You keep access until the end of your current billing period.
Pay, get the app. Don't like it, ask for a refund within 30 days and we'll give it back.

5. What you can do with the Service.

We grant you a personal, non-exclusive, non-transferable, revocable license to use TheraJoy for your own use, or — for Practice accounts — the use of your practice and its clients, in accordance with these Terms.

6. What you can't.

  • Reverse-engineer, decompile, or try to extract our source code.
  • Use the Service to provide a competing bilateral-stimulation service.
  • Share a single account across a team (Practice accounts have seat-based pricing for exactly this reason).
  • Use the Service to make medical claims about a named individual, or to hold the Service out as a treatment.
  • Abuse our staff. We will end the relationship if you do.

7. Your content.

Anything you create inside TheraJoy — presets, reflections, notes — is yours. You grant us a narrow license to store and process it for the purpose of running the Service for you, and nothing else. We do not use your content to train machine-learning models or for any other purpose.

8. Privacy.

Our handling of your personal information is described in our privacy notice, which is part of these Terms by reference.

9. For practices (BAA).

If you're on the Practice plan, the Business Associate Agreement you sign during onboarding governs our handling of any Protected Health Information (PHI) covered by HIPAA. That BAA supplements these Terms; where it conflicts, the BAA controls for PHI.

10. Availability & changes.

We'll try very hard to keep the Service up, but we don't promise zero downtime. We occasionally push updates that add, change, or remove features. Material removals are announced in the changelog, and we try to tell you by email when a feature you use is going away.

11. Disclaimers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.

The lawyers wrote this paragraph. We will still try hard.

12. Limitation of liability.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TheraJoy'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

13. Governing law.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts of Alameda County, California, unless you have a non-waivable consumer right to arbitrate or sue elsewhere.

14. Changes to these Terms.

If we update the Terms materially, we'll email you at least 14 days ahead. Continued use after the effective date counts as acceptance. If you don't agree to a change, cancel before it takes effect.
